Maryland Public Service Commission Steps in to Review Constellation Deal

The debate over the Constellation Energy Group's dealings with the French utility began yesterday. Maryland's Public Service Commission is holding hearings starting on August 19th that will determine whether Constellation Energy Group can sell up to 50% of its nuclear power resources to Electricite de France. The Public Service Commission is Maryland's highest ranking energy regulation authority and will determine whether the deal between Constellation and Electricite de France is in the public's best interest. Constellation was hoping the regulatory hurdle would not be placed in their path for closing the deal. They wanted to the complete the deal by September 17th of this year. Constellation is suing over the regulatory restriction.

Chairman Nazarian of the PSC has stated that the board will do their best to come to a decision before the deadline. Nazarian also said that the PCS recognized the compressed time line and urgency of the schedule but that it would likely be difficult to meet the schedule.

Fields, the attorney for the counsel of the people representing the consumer interests for matters involving utilities, indicated his office would likely need additional time to arrange witnesses.

Nazarian agreed to consider a request made by Cooper, the attorney representing Maryland's Public Interest Research Group, for at least one hearing to be held in the evening hours so concerned citizens could express any concerns they have.

On Tuesday, the state attorney general's office filed for a motion dismissing lawsuits from Constellation accusing the state of exceeding its regulatory authority by interjecting itself in the deal.
